Let's say I mass-produced 50 portable NOAC's and sold them on eBay. Could Nintendo(or anyone, for that matter) sue me for that?

Maybe if you sold 5,000 and were trying to pass it off as official Nintendo hardware. Otherwise, nah.

yeah, come on though make more than 50. Even 50,000 is not unheard of. some guy in Quebec had a ware house full of x-boxs modded to play off hDD.

Seriously 50,000 units... You could ebay lot sales of wii's and mod chips till you've meet the expected out put to be caught with a mire 50,000 units.
