got an email bk

Hello Anthony,

Thank you for contacting us regarding your buyer "miguel.freitas" who
threatened to leave you feedback if you don't refund £10 of their
postage. I appreciate this opportunity to assist you with this matter.

First of all, please allow me to inform you that with respect to your
feedback concern, I assure you that I have taken the liberty of
forwarding your email to the appropriate department who will be
reviewing the information you've provided. You should be hearing back
from them soon, as they're best qualified to respond regarding your
report.

Meanwhile, I'm sorry to hear about what happened. I am eager to sort
things out for you, unfortunately, situations such as these are
considered by eBay as a member-to-member conflict, which users should
resolve between themselves. The limitations on our responsibility are
explained in detail in our User Agreement, under the heading
"Liability". To read our User Agreement, copy the following link into a
new browser window:

http://pages.ebay.co.uk/help/policies/u ... ement.html" onclick="window.open(this.href);return false;

Moreover, please keep in mind that whether or not you will issue your
buyer a postage refund is entirely dependent upon your discretion. eBay
is not involved in transactions between buyers and sellers and therefore
is not responsible for issuing refunds. I'm afraid that we cannot take
sides in a dispute or communicate with the buyer on your behalf. The way
in which you and the buyer deal with this situation is really a matter
of your own discretion.

Thus, in cases such as these, I would still encourage you to talk to
your buyer through phone and simply discuss this matter with them. A
simple conversation may help in working out a solution that will satisfy
you both.

Here's how to request your buyer's phone number:

1. Click "Advanced Search" in the top right-hand corner of the eBay
homepage.
2. Click "Find Contact Information".
3. Enter the relevant item number. You can find the item number in My
eBay. Click "Search".

We'll then send you an automatic email with the buyer's contact details.
Please be aware that we'll send them your contact details at the same
time. We feel it maintains trust and fairness on eBay if members are
made aware when other members request their contact information.

I know this may not have been the answer you were hoping for, but I hope
I've at least been able to explain things clearly.

Kind regards,

Joe Diago

In other words "you're on your own, buddy".

You have three choices therefore, give him back some money he doesn't deserve to avoid negative feedback, or stick to your guns and "it doesn't matter". There is a third option, what I would do in your circumstances, open a dispute - that way, if he leaves unfair feedback you are far more likely to have it removed.

I think this is best. I hate ebay. It's the worst. Happened to my dad before, bought a projector off ebay for $3000 said it was near mint condition. Opened it up and didn't work, we contacted the seller, and he said 'who says mint condition means it works' AND EBAY SIDED WITH HIM  After a year and a half my dad finally gets money back from paypal. $8.12 because that was all the guy had in his account. It sucked. Hopefully yours goes better.

I wouldnt refund the money. He knew he was paying that much when he bid by bidding hes agreeing to YOUR terms.

Also a word of warning about listing items in other categories. If you get caught at the very least they delete your auction but still charge you for it. At the worse you get your account suspended. not realy worth the risk.

That's still usually only if somebody reports it, but I still wouldn't do it, because there's a lot of asses out there who will (report it).

Don't forward this guy any more emails. You have tracking for that package, I hope? He might try to say that he never got it.

This message once again does not answer my questions raised I quote:

As mentioned in the last email we sent you, a belief that a comment is
untrue, undeserved or left in retaliation is not one of the
circumstances in which we'll remove Feedback

However Blackmail is against your EULA, to which the buyer did do. Your system of rating sellers but not bidders is a joke. There is no protection for sellers from bidders like "miguel.freitas". who have clearly tried to blackmail me and yet ebay will do nothing about removing the feedback. I forwarded you the message from ebay stating it was at my own digression that i refund the buyer. I have chosen not to, yet his negative feedback still stand despite the fact he is not only breaking the law but EULA aswell. Now can i have a direct answer before i contact a legal advisor will the feedback be removed?

Threaten the buyer with a lawsuit, not ebay. They will likely back down, after all, if somebody threatened to sue you, wouldn't you back down?
